 Alberta Land Stewardship Act Rules of Practice for Conducting Reviews of Regional Plans

Under Section 10(1) of the Alberta Land Stewardship Regulation, rules established by the Stewardship Minister respecting the conduct of a review by a panel.

Code of Conduct for Panels Established Under Section 19.2 of the Alberta Land Stewardship Act

Sets out the proper practices of the review panel with respect to confidentiality, integrity, impartiality, and conflicts of interest or apparent conflicts of interest.

Individuals appointed on June 23, 2014 by the Stewardship Minister to provide their recommendations in response to requests for review of the Lower Athabasca Regional Plan. 

Lower Athabasca Regional Plan Review Panel Recommendations

In response to Requests for Review by six First Nation and one Métis community, a panel conducted a review and submitted their recommendations to government on June 22, 2015. 

 

 

Requests for Review

The Government of Alberta received Requests for Review of the Lower Athabasca Regional Plan from:

· Athabasca Chipewyan First Nation (ACFN)

· Mikisew Cree First Nation (MCFN)

· Cold Lake First Nations (CLFN)

· Onion Lake Cree Nation (OLCN)

· Fort McKay First Nation and Fort McKay Métis Community Association (FMFN)

· Chipewyan Prairie Dene First Nation (CPDFN)

 

who believed they were directly and adversely affected by either a specific provision or provisions in the Lower Athabasca Regional Plan. The Stewardship Minister deemed these applications complete, therefore all applications were considered in the review.

 

 

Panel Members and Requirements

A Lower Athabasca Regional Plan Review Panel was appointed on June 23, 2014 by the Stewardship Minister from a roster of qualified candidates established through a public Expression of Interest advertising campaign.

 

The Alberta Land Stewardship Act (ALSA), the Alberta Land Stewardship Regulation, ALSA Rules of Practice for Conducting Reviews of Regional Plans and the Code of Conduct for Panels Established Under Section 19.2 of ALSA guided the work of the panel. 

 

The panel was asked to provide advice on whether applicants were directly and adversely affected by the regional plan, and, if so, to identify specific provisions in the plan that affected the applicants and explain the adverse effects. The panel did not have authority to consider or award costs in relation to the review.

 

 

Review Process and Recommendations

To develop their advice, panel members reviewed the six applications and associated supporting materials as well as written responses from Alberta Justice and Solicitor General counsel and the applicant's written replies to those responses. Panel members also requested further information from these parties to permit a full and satisfactory understanding of the matters in the review. All parties had an opportunity to reply to responses to these information requests.

 

Panel members reviewed these materials then drafted and submitted their recommendations to the office of the Stewardship Minister on June 22, 2015 within one year of their appointment.
